You are responsible for:

  • Maintaining the confidentiality of your login credentials.

  • Restricting unauthorized access to your account.

  • Ensuring information published on your digital business cards is accurate.

  • Notifying us promptly if you suspect unauthorized access.

  • Ensuring that individuals whose information you submit have authorized its use and publication.

You are responsible for activities conducted through your account, except to the extent that applicable law provides otherwise.

4. Digital Business Card Content

You retain ownership of the content you provide, including your name, photographs, business logos, contact information, and business descriptions.

By submitting content for use in our services, you grant AppsDeveloper.cards a limited, non-exclusive licence to use, reproduce, format, display, and store that content as reasonably necessary to design, host, maintain, and deliver your digital business card.

You represent that you own the content or have permission to use it and that its publication does not violate another person's rights.

You must not submit content that:

  • Is unlawful, fraudulent, misleading, defamatory, or threatening.

  • Infringes copyright, trademarks, privacy rights, or other legal rights.

  • Contains malicious software or harmful code.

  • Promotes illegal activities.

  • Violates applicable laws or regulations.

We reserve the right to remove or restrict content that reasonably appears to violate these Terms or applicable law.

5. Intellectual Property

The AppsDeveloper.cards website, service platform, software, design elements, branding, original graphics, and other materials supplied by us remain the property of Apps Developer Dot Ca Inc. or their respective owners, except for customer-owned materials and third-party content.

You may not copy, reproduce, modify, distribute, reverse-engineer, resell, or commercially exploit our proprietary materials without prior written authorization, except where permitted by law.

Upon full payment, you may use the custom digital business card design created for you for its intended business purpose, subject to any separate written agreement and third-party intellectual property rights.

6. Pricing, Payments, and Taxes

Prices, design fees, hosting fees, renewal charges, and other applicable costs will be disclosed in the applicable quotation, order, invoice, or service description.

Unless otherwise stated:

  • Prices are in Canadian dollars.

  • Applicable taxes, including GST, are additional.

  • One-time design fees and recurring hosting fees are separate charges where specified.

  • Payment is due according to the terms stated on your invoice or order.

  • Promotional pricing and coupons are subject to their stated conditions and expiry dates.

You authorize us or our designated payment provider to process payments you have expressly agreed to make.

7. Hosting, Renewals, and Expiry

Where hosting is included or purchased, the applicable hosting period, renewal price, and renewal date will be specified in your order or service agreement.

You are responsible for renewing hosting when required to maintain continued service.

If hosting expires or payment remains overdue, we may suspend access to or publication of the affected digital business card after reasonable notice, subject to applicable law and any separate written agreement.

We will make reasonable efforts to notify customers about upcoming renewals when appropriate. You should maintain your own copy of important business information and any content you wish to retain.

8. Changes, Cancellations, and Refunds

Design changes, content updates, and additional work may incur fees where specified in your quotation or service agreement.

Cancellation requests must be submitted to us in writing.

Refund eligibility will depend on the service purchased, the work completed, the applicable agreement, and any rights provided by law. Custom design work, completed services, and hosting already provided may not be refundable except where required by law or agreed in writing.

Nothing in these Terms excludes mandatory consumer rights, statutory cancellation rights, or other protections that apply under Canadian law.

9. Service Availability and Maintenance

We aim to provide reliable access to our services but do not guarantee uninterrupted availability.

Access may occasionally be affected by maintenance, technical failures, internet disruptions, security incidents, third-party hosting problems, or circumstances beyond our reasonable control.

We may modify, update, or discontinue features where reasonably necessary to maintain or improve our services. Where practical, we will provide notice of significant changes affecting paid services.

10. Third-Party Services and Links

Digital business cards may link to external websites, social media platforms, mapping services, payment providers, or other third-party services.

These third-party services operate independently and are subject to their own terms and privacy policies. We do not control or guarantee their availability, content, security, or practices.

You are responsible for reviewing the applicable third-party terms before using those services.

11. Privacy

Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy, available at https://appsdeveloper.cards.

By using our services, you acknowledge that you have had the opportunity to review that policy.

We handle personal information in accordance with applicable Canadian privacy laws, including Alberta's Personal Information Protection Act where applicable.

12. Prohibited Use

You agree not to:

  • Use our services for unlawful purposes.

  • Publish false, deceptive, or unauthorized business information.

  • Interfere with the security or operation of our website or platform.

  • Attempt unauthorized access to accounts, systems, or data.

  • Upload viruses, malicious code, or harmful content.

  • Abuse, overload, or disrupt our services.

  • Use our services to violate another person's intellectual property or privacy rights.

We may suspend or terminate access when reasonably necessary to address serious violations, security risks, unlawful activity, or non-payment, subject to applicable law and contractual obligations.

13. Disclaimer of Warranties

To the extent permitted by law, our website and services are provided on an “as available” basis.

We do not guarantee that our services will always be uninterrupted, error-free, compatible with every device, or free from all security vulnerabilities.

We do not guarantee specific business results, sales, leads, search engine rankings, customer engagement, or marketing outcomes from using a digital business card.

Nothing in this section excludes warranties, guarantees, or rights that cannot legally be excluded under applicable law.

14. Limitation of Liability

To the extent permitted by applicable law, Apps Developer Dot Ca Inc. will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the use of, or inability to use, our services, including loss of profits, business opportunities, or anticipated savings.

Our liability for direct losses will be determined in accordance with applicable law and any valid written service agreement.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability that cannot lawfully be waived.

15. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, and reasonable costs arising from your unlawful use of our services, your material breach of these Terms, or content you provide that infringes another person's rights.

This provision does not apply to the extent that a claim results from our own negligence, unlawful conduct, or other circumstances for which liability cannot legally be excluded.

16. Suspension and Termination

You may discontinue using our services at any time, subject to outstanding payment obligations and any applicable service agreement.

We may suspend or terminate services where reasonably necessary because of material breach, non-payment, unlawful activity, security concerns, or discontinuation of a service.

Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.

Upon termination, access to hosted digital business cards may cease. Any outstanding payments, accrued obligations, and provisions intended to survive termination will remain effective as applicable.

17. Changes to These Terms

We may update these Terms of Use periodically to reflect changes to our services, business practices, or legal requirements.

The revised version will be published on this website with an updated date. Where required by law or contract, we will provide notice or obtain consent before changes take effect.

Continued use of our services after updated terms become effective constitutes acceptance only to the extent permitted by applicable law.

18. Governing Law

These Terms of Use are governed by the laws of the Province of Alberta and the applicable laws of Canada.

Subject to mandatory consumer protection laws and applicable jurisdictional requirements, disputes relating to these Terms will be addressed by the courts with appropriate jurisdiction in Alberta.

Nothing in this section limits any legal rights you may have under mandatory consumer protection legislation.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

20. Entire Agreement

These Terms, together with our Privacy Policy and any applicable written quotation, order, or service agreement, constitute the agreement governing your use of the relevant services.

If a separate written agreement conflicts with these Terms, the separate agreement will prevail for the specific services it governs, to the extent stated in that agreement.
